In its resolution on Trade Union Rights (Freedom of Association) in 1949, ECOSOC decided to transfer the decisions concerning Freedom of Association taken by the ILO to the Commission on Human Rights in order that it may consider the contents of the Freedom of Association and the Protection of the Right to Organize Convention of 1948 when drawing up for submission to the Council its final proposed text of the International Covenant of Human Rights and Draft Articles of Implementation.
The Freedom of Association is safeguarded in the International Covenant of Civil and Political Rights (ICCPR), Article 22.
